It means that you are offered the right to reside and work in UK without any restrictions regarding immigration. The right of abode comes under UK immigration law which means the bearer of the right can reside in UK without any restriction. This right was represented under the Immigration Act 1971. Currently, the right of abode in UK has been established by the British Nationality Act 1981 and consequent amendments. Here are two important things to know about right to abode in UK

  • No requirement of visa to come to the country

The right to abode in UK is enjoyed by British Citizens automatically while some commonwealth citizens also possess right to abode. A person having a UK passport that describes him or her as a British citizen can prove that he or she has right of abode. British Citizens already bear the right of abode in UK of Great Britain and Northern Ireland. If you don't have that passport to describe you as a British citizen, you need to submit an application for a certificate of entitlement.

You can prove you have right of abode if you have a UK passport describing you as a British citizen or British subject with right of abode. Here are also some rules about the people who can have right of abode:

  • People who are commonwealth citizen in UK on 31st Oct, 1982 bear this right
  • Those who are having a parent as citizen of UK at the time of their birth also possess right of abode
  • A female commonwealth citizen or British Subject who married to a man having right of abode automatically bear the right of abode

Here, one thing to be noticed is that person who born in 1983 or later can bear the right of abode only if he or she is a British Citizen.
